Andrei Dumitrache became a partner within Pachiu & Associates in 2008. In this capacity, Andrei is currently heading the “Banking & Financing” and “Tax & Estate / Wealth Planning” Departments within the firm, fields in which he made himself noted and therefore built up an extensive expertise, including prior to his appointment as a partner, as a department coordinator.

In the banking and financing field, Andrei has extensive legal practice in providing solutions and legal counsel in matters related to (i) project financing and credit reorganizations in various industries, (ii) authorization, regulation and current activity of credit institutions and non-banking financial institutions, including matters related to financial products, financing, leasing, forced executions, portfolio reorganizations and assignments, activity authorization; (iii) public funds financing as well as financing for public private partnerships, including infrastructure projects; (iv) receivables re-financing and assignments with an exposure to public authorities in various fields of activity; (v) project or corporate financing through private equity structures or through public tenders running on capital markets; (vi) capital market operations, including products and services pass porting on the basis of the free circulation of services.

Among the clients to whom Andrei, assisted by the Banking & Financing team at Pachiu & Associates provided or currently provides legal counsel are: Unicredit Bank Austria (one of the biggest syndicated corporate financing in 2008 granted to Petrom S.A.), Erste Bank (one of the biggest syndicated corporate financing in 2009, value of 500 mil. Euro), SEB Finans, Porsche Bank; Porsche Leasing, Union Bancaire Prive, Union Bancaire Swis, Bank Gutmann, Investkredit, Criteria Caixacorp Sociedad Anónima, Visa Inc., Millenium Bank, RABO FARM.

Also, in 2009, Andrei, assisted by the firm’s financing team, successfully assisted one of the pioneers of the Romanian telecommunication infrastructure projects regarding a financing exceeding EUR 6 million for the implementation of an optical fibre telecommunication infrastructure project in one of the major Romanian cities.

In the field of tax and estate planning, Andrei has acquired a solid legal practice regarding the direct and indirect taxation, especially in the capital foreign investment field in Romania and income repatriation. In this respect, Andrei, assisted by the other team members of the firm’s Tax & Estate Planning department, offered a series of solutions regarding issues such as tax optimization and structuring of investment and investment income, with a main focus on the financing by debt or equity, both to the firm’s foreign clients and to the Romanian clients, allowing them to take into account and enjoy all the tax related rights and benefits granted both by the Romanian tax legislation and the European Union legislation. For the purpose of identifying and implementing the best solutions, Andrei developed solid and long term partnerships with financial institutions, law firms, accounting and audit firms as well as business consultancy firms having various jurisdictions within Europe, Asia and the United States of America, according to which the solutions to the most complex tax related issues arising from the international trade of goods or cross border investment.

In addition to the activities related to the above mentioned fields of activity, Andrei also coordinates the marketing and PR activity of our firm and is an active supporter of the firm’s involvement in various pro bono activities.
