Alexandru Lefter became a partner within Pachiu & Associates in 2008. In this capacity, Alexandru is head of the “Corporate and Mergers & Acquisitions”, „Labour Law” and “Competition” Departments, having accumulated in the six years of legal practice extensive expertise.

As regards the Corporate and M&A activity, Alexandru was involved in several investment projects, providing legal counsel, among others, in matters related to (i) the taking over of the business entities by investment funds in various fields, such as industry, insurance, leasing companies etc., inclusively by coordinating certain complex due diligence practices; (ii) the implementation, authorization and development of Greenfield and Brownfield projects in various areas and industrial parks in Romania; (iii) the development of real estate projects along with the financing and granting of related securities; (iv) the restructuring of business entities; (v) the structuring of joint-ventures in various fields etc. In addition to providing legal advice related to the organization and compliance of the investment projects, Alexandru represented the clients in matters related to the relationships maintained with the central and local authorities, which may have a major part in the actual implementation of the investment projects.

In the Competition field, Alexandru has extensive expertise in providing assistance with regard to (i) the structuring and authorization of economic concentrations, (ii) the analysis and structuring of various distribution circuits, as well as authorization of such schemes, (iii) the analysis of commercial relations and contracts in view of Competition Law for the purpose of preventing cases of non-compliance, such as vertical and horizontal understandings, creation of a dominant position, imposition of linked sales, etc. Assisted by the members of the Competition Department, Alexandru offered legal counsel to various clients in front of the Competition Council, obtaining each time the approvals required for the implementation under the most advantageous terms of commercial operations intended by its clients.

In the Labour Law field, Alexandru has an extensive expertise in drafting individual labour agreements and addendums thereto, collective labour agreements, rules of the interior, legal opinions, in drafting memoranda. Furthermore, rendering of assistance in matters regarding collective or individual dismissals (disciplinary included) of employees or regarding the procedures to be followed for the purpose of providing rights to the employees in the event of a take-over of the employer's business or part thereof. Moreover, in collaboration with the Dispute Resolution & Insolvency Department, Alexandru successfully represented various clients in labour disputes.

Among the clients assisted by the departments headed by Alexandru are: Emerson Corp. (Greenfield investments), WPP Group (structuring of the corporate portfolio in Romania and all the related company law aspects), Bluehouse, Thyssen Krupp Elevators, Enterprise Investors (purchase of majority stock in a company for cryogenic sampling and preservation of stem cells), ISS Facility Services, AEW Europe. In 2009, Alexandru successfully assisted the Bulgarian group Eurohold in the authorization by the Competition Council of the potential takeover of IPSO (the Romanian dealer for Renault, Nissan and Dacia).

In addition to the professional activity related to the firm’s clients Alexandru also supervises the professional growth of lawyers within the firm, as the follower and promoter of an ongoing professional improvement, irrespective of the Seniority degree of the relevant lawyers.
